GENERAL ORDERS No. 1.
I...All persons owning Real Estate in the town of Tucson, and within three miles thereof are hereby required to register their claims, describe their property, and give an abstract of their titles, in order that the same may be recorded in a book to which the public shall have access as a book of public records.
II...WILLIAM S. OURY is hereby appointed Register and Recorder (with power to appoint a Deputy), and he is empowered to collect, as his compensation in full, a fee of one dollar for each and every lot or parcel of land, registered and recorded by him. He will open an office on the 10th day of the present month, and all persons residing here shall have their property registerd [sic] and recorded, within one month from this date.
III...No one is permitted to encamp within fifteen miles of Tucson, for a longer period than twenty-four hours, without reporting to the Provost Marshal, and no settlement shall be made or camp formed, on any pretense, or any purpose whatever within the Military District of Western Arizona, without permission first obtained from the Commanding Officer. Gay, M. G. Lot No. 1 and 2 belonging to M. G. Gay by purchase from Manuel Aquayo. Consideration twenty-five dollars. No boundaries given. Deed bears date August 26th, 1861. Recorded Aug 11th, 1861. Wm. S. Oury, Recorder.
Aldrich, Mark. Lot 3. Sold by Francis Ruelas to John M. Pinkston. Transferred by said Pinkston to Solomon Warner & Co. Sold at public sale by the Arbitrators of Soln. Warner & Co. And purchased by M. Aldrich for the consideration of thirty four dollars. Bounded as follows: Situated on the East side of the Plaza commencing at the adobe fence and running west twenty five (25) varras more or less to a stake marked in the ground, thence North thirty five (35) varras more or less to another stake, thence East to the said adobe fence. Lot 4. Transferred by John A. Mahon to M. Aldrich for the consideration of twenty (20) dollars. Situated on the south side of the main plaza between the dwellings of Pasqual Ochoa and Pasqual Cruz having twenty five (25) varras frontage on the said plaza by twenty six (26) varras in depth. Aldrich, Mark. Lot No. 5. Sold by Jose Ma Martinez to Joaquin Burruel by Burruel to Francisco G. Toraño of Magdalena, Sonora and by him deeded to Mark Aldrich for the consideration of one hundred and eighty dollars. Bounded and described as follows. Commencing at a stake about twenty (20) feet on a line west of the north west corner of the adobe house and running south parallel with the Main Street seventy five (75) yards to a stake in the premises of Marcus Veramundi, thence running east sixty (60) yards to a stake, then running north 75 yards to the adobe wall and premises of Rafel Herrero, and thence running west along said wall sixty (60) yards to the place of beginning. Stevens, H. S. Lot No. 6. Vacant ground taken up by Sam'l Lewis who made the improvements on the lot viz an adobe house and picket corral. Sold by said Lewis to Geo. Pope and transferred by Patricia Granilla (Pope's wife) to Hiram S. Stevens for the consideration of one hundred (100) dollars. Bounded and described as follows. Beginning at a point on the Overland Mail Road running north two hundred (200) yards, thence east two hundred (200) yards, thence south two hundred yards, thence west two hundred yards to the place of beginning. Aldrich, Mark. Lot No. 7. Deed from Geo. Mallison to Mark Aldrich for a consideration of one hundred ($100) dollars. Bounded and described as follows. Commencing at the north west corner of the house of Alfred Fryar running thence paralel [sic] with the stage road sixty five (65) feet, thence south east forty eight (48) feet to an adobe wall, thence along said boundary wall sixty five (65), thence forty eight (48) to the place of beginning. Lot No. 8. Deed from Alf. Fryar to George Pope deeded by said Pope to M. Aldrich. Consideration two hundred (200) dollars. Bounded and described as follows: bounded on the north by the lot of M. Aldrich, on the south by Government building known as the Guardia, on the east by the old Military Plaza, on the west by Main Street leading from Tucson to Gila River. Aldrich by deed on or about the 20th of June 1861. Consideration one hundred and fifty dollars. Bounded and described as follows. Bounded on the north by lot of said Aldrich, on the east by the old Military Plaza, on the south by street leading into La Plaza de las Armas, on the west by Main Street leading to Fort Yuma. The one seventh part he received by will from his father the other 6/7th he obtained by purchase from the heirs- to wit from Doña Jesus Pacheco 1/7, consideration twenty (20) dollars; Dona Guadelupe Sardina 1/7 consideration fourteen (14) dollars; Refugio Pacheco and his two sisters Guadalupe and Carmen 1/7 consideration fourteen (14) dollars; Concepcion Gonzales and his brother Angel 1/7 consideration fifteen (15) dollars; Ramon Pacheco 1/7th consideration a wagon; Rafel Ochoa 1/7 consideration twenty five (25) dollars. Herrero, Jose. Lot No. 12 taken up by Bernadino Campa and the house and corral built by him sold to José Herrero in the month of October 1861, consideration two hundred twenty five (225) dollars. Bounded as follows. Beginning at the intersection of the south side of the Calle de la Mesilla with the west side of the Plaza de la Mesilla running south with said Plaza 23 1/2 varras to the premises of Antonio Comduran, thence west 33 varras with the line of Antonio Comduran, thence north twenty three and one half (23 1/2) varras to the Calle de las Mesilla, thence east along the line of said street thirty three varras to the Plaza and place of beginning. Warner, Solomon. Lot No. 13. By deed from Saml Hughes, consideration ten (10) dollars. Bounded and described as follows. Beginning at the northwest corner of Solario Asedo's corral or yard fence running in an easterly direction about twenty yards more or less, thence continuing in an easterly direction along the north side of Chino Dias' lot about 20 yards more or less to where it joins the lot purchased by S. Warner from McGovern, from this corner running north 40 yards more or less to the arroya, thence down the arroya 40 yards more or less, thence to the place of beginning forty yards more or less. Urquides, F. Lot No. 15. Inherited by José de Leon from his father José Domingo de Leon deeded by said Jose de Leon to Juan Spence deed by said Spence to Thomas F. McGovern and his copartners G. Smith and W. Gifford by them deeded to Fernando Urquide and by him transferred to Da Jesus Ramirez by deed bearing date August 4th 1860. Bounded and described as follows to wit- commencing at the corner of the Main Street and running west along the lane which leads to the field forty nine (49) varas where it joins the property of Franco Romero, thence north along the line os said Romero seventy one (71) varas to the garden of Da Dolores Avila, thence east along the said Avila forty (40) varas to the Main Street, thence south along said Main street seventy five (75) varas to the place of beginning. Urquide, F. Lot No. 16. Inherited by Anita Burruel from her father Juan Manuel Burruel deeded by her to Manuel Hernandez and by him transferred to Fernando Urquide. Bounded and described as follows. Romero, Francisco. Lot No. 17. First deed of gift from Teodoro Romero to his sister Ana Maria Romero bears date 1828; by her sold to Juan Romero and by him sold to Jose Romero and inherited by Fran. Romero from him. Bounded and described as follows. Being a piece of ground in front of the Old Guard House of the Precedeo where where [sic] a row of pomengranete trees runs straight toward the north, there there [sic] is a small corner belonging to my sister, thence with a small ditch running to the north (here the paper is so mutilated it is impossible to read more). Warner, Solomon. Lot No. 18. Sold by Cornelio Elias to a Abrahams and by him deeded to Rosecran and Co. and by them deeded to Gardener & Ward and by Ward to Chas. Rathboon, and by Rathboon to Saml Hughes as was also the half belonging to Gardener, by Saml Hughes deeded to Soln Warner. Consideration two hundred and fifty (250) dollars. Bounded and described as follows. On the east by the Main street, on the south by the property of Cornelio Elias, on the west by property of M. Aldrich, on the north by property of Soln Warner and has a front on the Street of 20 feet more or less, by 40 feet more or less in depth. Deed bears date Feby 7th, 1862. Recorded Aug. 15th, 1862. Wm. Elias, Manuel Ignacio. Lot No. 25. Inherited from his father Francisco Duran & been in undisturbed possession for the last 25 years as shown by affidavit before Lt. L. E. Situated on the Plaza de las Armas having thirty two (32) varas from east to west & fifteen (15) varas from north to south. Described and bounded as follows: on the east by the main street, on the south by the alley which divides it from the lot of Fernando Urquide, on the west by the property of Felipe Romero, and on the north by the old property of his father, containing twenty three (23) varas front by eighteen (18) varas in depth. Gallardo, Naci. Lot No. 29. Taken up by Nacario Gallardo and the improvements- a house and corral made by him. The house built May 5th, 1859. Ramirez, Theodoro. Lot No. 30. Declaration of Tho. Ramirez to this effect that he bought the property from his mother in law Doña Reyas Peña. The property is bounded and described as follows: on the north by the old Presidio Wall, on the east by the property of Dolores Grijalva, on the south by the old Military Plaza, on the west by the property of Wm. Dunne, Pat. Lot No. 31. Held by a deed B. G. Weld by his attorney H. S. Washburn to C. T. Haden and M. J. Flourney, by them transferred by deed to David Davis and by David Davis sold and deeded to Pat H. Dunne. Consideration 800 dollars. Bounded and described as follows. Commencing at the corner of the house of T. F. McLean running south 48 feet along the Main Street to the street leading into the Plaza, thence east 110 feet to the line of the Plaza, thence north along the line of the Plaza 48 feet to the corner of the lot of said McLean, thence along the line of said McLean 41 feet to the place of beginning. Beginning at the corner of the property formerly owned by Nacario Gallardo and running east 100 feet 10 inches to the property of Rafael Herreras, thence south 15 feet to the line of said Herreras, thence east again along the line of said Herreras 76 feet to the property of Ignacio Saenes, thence south along the line of the said Saenes 48 feet to the property of Mark Aldrich, thence west along the line of said Aldrich 176 feet 10 inches to the Mission Street, thence north along said street 63 feet to the place of beginning. Telles, Guillermo. Lot No. 33. He declares that he took and built upon this lot two years ago and petitions that he may be be [sic] allowed to live in the enjoyment of it and will pay what the governments may demand for a title to the property. Romero, Francisca. Lot No. 34. Taken up by Francisca Romero & built upon during May of 1862 and has been in the undisputed possession of the same to this date. Josefa C. de Fernandez. Lot No. 35. Lot was granted to Teodora Marin by Jose Grijalva at that time judge (May 26th, 1847) and by Marin transferred to Rafil Saens, transferred by him to Doña Josefa C. de Fernandez by deed bearing date Feb. 10th, 1859. Aldrich, Mark. Lot No. 36. By deed from Manuel Burruel and Jesus Ortez to S. Warner & Company December 19th, 1857 and by the arbitrators of S. Warner & Co. sold to Wm. Buckley Feby. 9th, 1859 and by him transferred to M. Aldrich July 11th, 1859. Consideration $580 dollars. Bounded & described as follows. Bounded on the north by the property of Edward Miles, on the east by the property of Corneles Elias, on the south by the property of José Ma. Bounded and described as follows: contains nineteen (19) varas from west to east and at the southern end nineteen (19) varas and at the northern end fourteen (14) varas and is situated on the north side of the town and immediately outside the old Presidio wall. Oury, on the east by the Calle del Correo, on the south by property formerly owned by Concepcion Gonzales and on the west by the property of Joseph Cummings. Deed bears date Aug. 19th, 1852. Pacheco, Ramon. Lot No. 45. Deed from Francisco Dias and his wife Bernarda Gonzales to said Ramon Pacheco, consideration two hundred (200) dollars. Doss, R. M. Lot No. 99. Purchased from Heydan & Flournoy, consideration two thousand (2000) dollars by said Richard M. Doss, who says that in the month of March 1862 he was attacked on the highway by the Apache Indians who drove him from his wagon in which he had his trunk, which was broken open and the contents carried away by said Indians, amongst which was the deed to this property. Solares, Manuel. Reclamation of said Solares of a piece of land as the representative of his wife Ursula Mendoza who he declares possessed and cultivated a piece of land pertaining to the lands of the mission of Tucson. He further declares that in the month of Dec. 1857 said land was arbitrarily taken away from his wife, then a widow, by the military commander of the colony, thereby depriving her of the means of subsistence. That at the time of the removal of the troops of the colony to Sonora on account of the purchase of this territory by the United States, Manuel Gandera at that time civil and military governor of Sonora, issued an order to the assistant inspector requiring him to give order to Capt. Hilario Garcia, at the time the commander of the colony, that all lands taken from citizens for the benefit of the military colony during the year 1851 should be restored to their legitimate owners, which order was not obeyed on the contrary that some of the lands were appropriated by the officers to their own use amongst them the lot claimed by M. Solares as the property of his wife as well as some others was taken possession of by one Lieutenant Manuel Romero who retains possession of the them up to the present time, greatly to the prejudice of their legitimate owners all of which is respectfully represented by said Manual Solares. Castro, Ramon. Reclamation of a piece of land which said Castro declares was arbitrarily taken away from him in the year 1853 and applied to the uses of the Military Colony then existing in the Presidio of Tucson. He further says that at the time this country was transferred to the jurisdiction of the United States by purchase from the Mexican Government that Manuel Gandara at the time Governor of the State of Sonora issued an order to Hilarion Garcia, the commander of the military Colony, that all the lands which had been appropriated to the uses of the colony should be restored to the citizens who had been their legitimate owners, which order instead of being executed by said commander Garcia he applied the lands to his own uses and those of the other officers under his command. He furthermore declares that this piece of land had belonged to an Indian woman named Tomasa from whom he had purchased it and that he had been some years in possession of and cultivating the land. Thomas Burruel as attorney for Manuela Burruel reclaims a piece of land being part of the field belonging to the old Mission of Tucson, which he declares was donated by the priest, Juan Bautista Llorenz to Pedro Rios for services as interpreter during the conquest of the Indians by the Mission. That the deed to said Rios together with all the transfers was carried away by the Apaches in an attack made on the town of Tucson many years since by said Apache Indians at which time it was in possession of Ramon Burruel who owned and cultivated uninterruptedly for some years, that said Ramon Burruel died about the year 1856 leaving the property to his mother and she dying soon after it was inherited by her daughter, the above mentioned Manuela Burruel, who having hauled pickets on to the land for the purpose of fencing it had the land taken from her arbitrarily by order of Ygnacio Saens, the judge of the Presidio who gave it to his relations Calistro and Ygnacio Sosa and that as since that time there has been no competent court in the country before which to lay the claim the property has remained in the possession of the said Sosa's, all of which is submitted in order that when there is a proper tribunal in the country the claim may be adjudicated. Herran, Dolores. Reclaims two pieces of land being a portion of the lands of the old Mission of Tucson which he declares was the property of his father by purchase from one Carlos Rios and that in the year 1853 said lands were arbitrarily taken from his father and appropriated to the uses of the Military Colony at that time established in this village and that at the time the country passed to the jurisdiction of the United States by the purchase of the same from the Mexican government an order was issued by Manuel Maria Gandera, then governor of the State of Sonora, that all lands which had been taken from private citizens of the village of Tucson for the uses of said Military Colony should be restored to their proper owners, which order was not complied with by Capt. Hilarion Garcia, who was at the time commanding the post. On the contrary that many of the lands were applied to their own private uses by said capt. H. Garcia and the other Military officers and that amongst there were the two pieces which are reclaimed by said Dolores Herran as heir at low of Francisco Herran decd., all of which is respectfully submitted. This is a mortgage given by said Aguayo to Juan Fernandez as security for the payment of two hundred dollars in gold loaned by said Fernandez to said Aguayo for the term of six months. Allen, John B. This is a small garden deed to Mark Aldrich by Jesus Ma. Ortiz attorney for the son of Jose Ma. Elias, consideration fifteen (15) dollars. Record of Mines
No. 1. A mining claim of twelve hundred yards square to be called the Keo-Chin i cum Mine has been taken up by Abraham Lyon, Charles O. Brown, Wm. S. Oury, Geo. Bryant, and Michael Lydon. Said claim commences at the south west end of the survey made by H. S. Washburn of the lead known as the "Tiger Silver Lead" and following the vein with all its dips , angles, and spurs and is situated in what is known as the Cokespa mining district, Arizona Territory. Field No. 1. Deed from Antonio Ramirez to Bartolo Granillo, consideration one hundred (100) dollars. Bounded and described as follows. Contains from east to west one hundred and seventy five (175) varas and from north to south ninety seven (97) varas. Bounded on the south by the main callejon, on the west by the field of Dolores Bildeluca, on the north by the field of Franco. S. Elias, Manuel Ygnacio. Field No. 2. Deed from Tomas Telles and his wife to H. S. Strube, consideration thirty (30) dollars. Deed bears date April 18th, 1857. Transferred by said Strube to Manuel Ygnacio Elias, consideration sixty (60) dollars. Bounded and described as follows. Contains from east to west two hundred and twenty one (221) varas and from north to south three hundred and forty eight (348) varas. Bounded on the east by the field of Francisco Romero, on the south by the field of Jese Ma. Elias, on the west by the field of Jose Gallego, and on the north by the field of Ygnacio Saens. Field No. 3. Was granted to Franco. Nuñez in the year 1779 by the commanding officer of the post- Pedro Allande and by a succession of transfers all of which are contained in a paper book is now the property of Jose Herreras as the land has not been conveyed the exact amount is not known. Field No. 4. Was inherited by Juan Grijalva from his father Francisco Grijalva who purchased the land from parties without receiving any deed. Said Juan Grijalva on the third day of August 1852 petitioned the civil and military commander of the Presidio of Tucson, Manuel Romero, to give him a title paper to the land which document was forwarded to Bernabe Gomez assistant inspector of the district who acceded to the petition and ordered the commander Romero to issue the corresponding title, said field contains from north to south four hundred and sixty (460) varas and from east to west three hundred and forty (340) varas. Inherited by Ramono Gonzales from her father Jose Antonio Gonzales who purchased it from Marcos Castro, the title papers were lost and upon petition from said Ramina Gonzales, a new hijuela [document] was granted by the acting judge Miguel Pacheco which bears date May 16th, 1846. Said field contains from east to west three hundred and fifty (350) varas and from north to south three hundred and ninety (390) varas. Recorded Dec. 31st, 1863. Wm. S. Oury, Recorder.
